2010 Legislative Agenda

Senate bill 5431-A (Stachowski)/Assembly bill 8340-A (Morelle) Provides for mandatory continuing education for licensed massage therapists.

This legislation amends the education law by adding a new section 7807 to require mandatory continuing education for licensed massage therapists. It requires triennial registration with the State Education Department to practice in New York State and the applicant must pay a fee of $45.   There is a mandatory minimum of thirty six hours of acceptable formal continuing education during the triennial period.  In addition, such sponsors of continuing education shall remit a fee of $900 to the State Education Department.

Currently 37 states have mandatory continuing education for licensed massage therapists. If enacted, this law would protect public safety by ensuring LMT's are properly trained and up to date in the latest methods and techniques, while also protecting the profession by ensuring that all are held to the same standards. It would also give additional strength in combating illegal practices.

Assembly bill 10323 (Hoyt)/Senate bill number pending

This legislation provides that the Chair of the New York State Worker's Compensation Board can set a fee schedule for massage therapy services for injured employees.  Although massage therapists are licensed to provide care to patients in New York State, injured employees can only be reimbursed for massage therapy services on an ad-hoc basis with some worker's compensation carriers allowing it and others denying it.  This bill would establish a fee schedule for massage therapy in the same manner as physical and occupational therapy and allow an injured employee to receive reimbursement for massage therapy services.

STATUS:  Assembly Labor committee
